Since Fisker has not yet filed for bankruptcy, and since they are supposedly still employing 53 active executives, doing what, I don't know, I think it would be prudent forus, as a group of Fisker owners, to communicate directly to the board.

It cannot hurt to remind them that they have a fiduciary responsibility to the company, and therefore to us as owners who have explicit warranties which are not being honored.

This is a board that has remained totally silent in the face of many questions, not the least of which was allowing the DOE to sweep $21mm from their bank account, eating up a good part of their remaining cash.

The only way we have a chance of reactivating warranty work is either
through:
a. a purchase by third party in bankruptcy
b. a court ordered set aside of funds, if available, for warranty reimbursement to dealers.
c. ?????

I am not an attorney so I don't know if this is on shaky ground, but logic says that we have nothing to lose and everything to gain by trying to open up a line of communication.

If I get a lot of positive responses, and few negatives, then I would start to compose that letter for all to vet. Would like an attorney to weigh in on this.

Totally agree, we should contact them as a group - they have been silent for too long, and could do with some encouragement to communicate with the owners group.

After all, it sounds as though they have pretty much frozen out their dealers with whom they had contracts and business relationships. Why would they agree to communicate with us?

Perhaps if we showed up on the doorstep of corporate, they'd take notice.

You are assuming they paid rent and still have an office :).

It takes a while to evict. They are still a board. Would send a copy of the letter to the auto press.

I'm in. I'm very upset by the total lack of communications as I'm sure most owners and dealers are. I feel they have no respect for the individuals and dealers that have supported them.

Let's try this draft as a start, edit add and delete as you please:
Open Letter To the Board of Directors of Fisker Auto Company

Gentlemen:

We represent a group of at least xx passionate Fisker owners who regularly post on the Fisker Buzz Web Site. Although, we are from different parts of the country, and Europe, a quick read of our postings will immediately make you realize that we have one common thread. We Love our Fiskers!

This car is like no other manufactured and we enjoy driving them every day. Many of us far exceed 100mpg and some are approaching infinity, since we never drive more than 40 miles per day. If we had it all to do over again, most of us would still find reasons to have bought our Fiskers. Very few of us want to sell them, we would rather drive them until they die.


We also have another common thread--frustration. Frustration at the press bashing this company, frustration at the managment squandering opportunities to sing the praises of Fisker, frustration at Congress for using Fisker as a photo op for bashing the current administration, frustration at seeing our warranties no longer being honored.

And now we are frustrated at the silence and inaction of Fisker in the face of bankruptcy. We have seen the DOE sweep $21mm of your dwindling cash, we are told there are still 53 executives at the company, who we assume are still drawing reasonably hefty salaries, and yet you stand by in silence.

If you have a deal in the works, say so---we don't need the details of a secret negotiation, just a thread of hope that somehow our cars will be serviced and repaired when needed. If you do not have an impending sale, then when do you intend to file bankruptcy; after every dollar of remaining cash on hand is gone, and there is no money left to set aside for warranty work? If you do not have a deal, then file bankruptcy now and let the courts and trustees extract whatever remaining value there is from the company. There may yet be a company out there willing to buy the assets of Fisker, resurrect the brand and honor the warranties.

As the board of directors, you have a fiduciary responsibility to protect the corporation as best you can. Exercise that duty now.

Hopefully this works but there are only a limited amount of resources that FA has currently. Warranty service is probably pretty far down the line at this point. Obviously this "silence" thing is not working but you got to think that they are hoping a deal comes quick and this warranty thing will all be a memory (or permanent).

I really think that no one knows at this point. I think that these questions really cannot be answered by anyone (including the board).
